Mortgage Scheme Mastermind Pledged Guilty [NBC 10-06-2011]

Taylor, Bean & Whitaker was a top 10 wholesale mortgage lending firm. Taylor, Bean & Whitaker closed $35 billion in residential mortgage loans in 2007. The company ceased operations on August 5, 2009 following a suspension by the Federal Housing Administration from making FHA mortgage loans and Ginnie Mae mortgage backed securities the previous day. Two days earlier the FBI had raided the company’s Ocala headquarters. FBI agents had raided the headquarters of Taylor Bean & Whitaker on August 3, 2009 in what appeared to be an investigation related to TB&W’s acquisition of a majority stake in Colonial BancGroup. Taylor Bean & Whitaker had signed a deal on March 31, 2009 to become the majority owner of Colonial BancGroup in a $300 million equity stake. As of August 14, 2009 Taylor Bean & Whitaker ceased business operations and terminated all employees at its Ocala, FL office.

Mortgage Regulations Press Conference 12/18/07 (Part 2 of 2)

Today, Attorney General Martha Coakley filed final, revised mortgage broker and mortgage lender regulations with the Secretary of State and has issued official guidance to the broker and lender community to help them understand and implement the new consumer protection regulations governing mortgage brokers and lenders. The regulations, which take effect on January 2, 2008, codify several forms of mortgage fraud and unfair lending which contributed to the recent meltdown in the subprime market and the resulting foreclosure crisis in the Commonwealth.

Here’s a hint – MERS assigns to Wells Fargo.

Same day, same person, same notary assigns from Wells Fargo to Fannie Mae.

“So Janice works for Franklin American Mort Corp. in Flint, MI and Assigns the mortgage as an Asst. Sec’y for MERS to Wells Fargo in Iowa, and she has the assignment notarized in Dakota County, Minnesota.”

“Then, on the same day, she also works for Wells Fargo in Iowa, and assigns the mortgage to Fannie Mae in Philadelphia, PA and has it notarized again in Dakota County, Minnesota?”

“First, Lets just assume that it’s legal to have an assignment of mortgage from a company in Flint, MI to be notarized in Minnesota for a company located in Iowa. And then let’s also assume that a company in Iowa can have an Assignment of mortgage notarized in Minnesota for a company in PA.”

“Is this sort of behavior legal? Or could it be FRAUD? Hmmmmmm, Flint, MI to Dakota, MN, a mere 581.8 miles apart. That’s nearly a 12 hour drive w/o any highway mishaps, oh, and you better have the ability to walk on water, otherwise, its a 688 mile drive under Lake Michigan and over 12 hours. Typically, banking hours are between 8am & 5pm. That’s a total of 9 hours. Maybe she should have saved gas and just driven to Iowa. It’s only 10 hours away.”

Pretty neat trick huh?

There is something very sinister about this amazing time travel. It is my belief that these individual mortgage obligations live in more than one savvy MBS investor’s “book.” Each manifestation of the obligation is insured against default for the full outcome based appraisal “value.”

Each investor is made whole via insurance and thanks to AIG, who of course was caught by surprise, has no choice but to dump the whole mess on the taxpayer. Meanwhile, the “servicer” purchases (for pennies on the fiat) the right to pursue the extinguished debt and seek as many deficiency judgments as possible.

Not to mention the fact that clear chain of title on millions of homes (in default or not) are destroyed. Further, if the obligations fail to make their way to the trusts within the REMIC window, throw massive tax evasion into the mix.

HUD GIVING $50,000 TO HOMEOWNERS BEHIND ON MORTGAGE 7-5-2011

The Emergency Homeowners Loan Program will offer a zero interest, forgivable bridge loan to homeowners who have experienced a substantial loss of income (a reduction of at least 15%) due to unemployment or underemployment caused by adverse economic conditions or medical condition. Approved homeowners are eligible to receive one-time EHLP assistance to pay certain arrearages to bring them current, as well as ongoing monthly assistance to help them to make their monthly first lien mortgage payments (including payments of principal, interest, taxes, and insurances). Assistance is limited to a maximum duration of 24 months, or up to a maximum loan amount of $50,000 in mortgage payment assistance, whichever occurs first. The EHLP loan is secured by a junior lien against the approved homeowner’s principal residence and is forgivable over a 5-year principal reduction period.

For homeowners–making mortgage payments is a must to keep your house, but if you’re in danger of foreclosure, a new federal program could help. It’s called the Emergency Homeowners Loan Program (EHLP), and it could be the extra push that people need to prevent foreclosure.
